1. About This Service
makewill.co.uk is a trading name of Calm Ventures Ltd (company number [TBC]), registered in England and Wales. Our registered office is at [TBC].
makewill.co.uk provides an online will creation tool. We generate will documents based on the information you provide. We do not provide legal advice, and our service is not a substitute for independent legal advice from a qualified solicitor.
2. Eligibility
To use our service, you must be aged 18 or over, domiciled in England or Wales, and have the mental capacity to make a will (testamentary capacity). We cannot assess your testamentary capacity — if you have any concerns, please consult a medical professional or solicitor.
3. Our Limitations
Our service is designed for straightforward estates. It is not suitable for estates involving discretionary trusts, business succession planning, assets governed by foreign law, or situations where you wish to exclude a spouse, child, or dependant who may have a legal claim on your estate under the Inheritance (Provision for Family and Dependants) Act 1975.
If any of these circumstances apply, we strongly recommend seeking independent legal advice. While our complexity screening may flag some of these issues, the responsibility for determining whether our service is suitable for your needs rests with you.
4. Will Validity
The documents we generate are designed to comply with the formal requirements of the Wills Act 1837. However, a will is only legally valid once it has been properly executed — that is, signed by the testator in the presence of two independent witnesses, who also sign in the testator's presence.
We provide clear signing instructions with every will. Failure to follow these instructions may render your will invalid. We accept no liability for wills that are not properly executed.
5. Payment and Pricing
Payment is taken before your will document is generated and delivered. All prices are in GBP and include VAT. A full breakdown of charges is shown before you pay. There are no hidden fees, subscriptions, or additional charges.
6. Your Right to Cancel
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of placing it, without giving any reason.
However, our service delivers digital content (your will PDF) immediately after payment. Before completing your purchase, you will be asked to give your explicit consent for us to begin generating your will document straight away, and to acknowledge that you will lose your right to cancel once the digital content has been delivered.
If you do not give this consent, your 14-day cancellation period applies and you may request a full refund within that period. If you experience a technical issue preventing delivery of your document, please contact us at support@makewill.co.uk and we will resolve the issue or provide a full refund.
7. Intellectual Property
The content, design, and functionality of makewill.co.uk are owned by Calm Ventures Ltd. Your completed will document belongs to you. Our will templates and the underlying technology remain our property.
8. Limitation of Liability
To the fullest extent permitted by law, Calm Ventures Ltd shall not be liable for any indirect, incidental, or consequential loss arising from your use of our service. Our total liability for any claim shall not exceed the amount you paid for the service. Nothing in these terms excludes liability for death or personal injury caused by negligence, or for fraud.
9. Data Protection
We process your personal data in accordance with our Privacy Policy and the UK General Data Protection Regulation (UK GDPR). Will data is encrypted at rest and in transit.
10. Complaints
We have a written complaints procedure. If you are dissatisfied with any aspect of our service, please email complaints@makewill.co.uk. We will acknowledge your complaint within 7 days and aim to provide a full response within 14 days. Full details are available on our Complaints Procedure page.
You are not required to use our complaints procedure before taking other action — you may pursue independent arbitration or court action at any time.
11. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
